Tracy Morgan and Wal-Mart have announced that a settlement has been reached regarding an accident that occurred last June in New Jersey. Morgan and several other people were riding in a limo bus when a Wal-Mart tractor trailer, driven by Kevin Roper, collided with the limo. Morgan was critically injured during the accident, and comedian James McNair was killed.
As a result of the accident, Morgan suffered broken ribs, a broken nose, a broken leg and a reported brain injury.
"Wal-Mart did right by me and my family, and for my associates and their families. I am grateful that the case was resolved amicably," Morgan said in a statement.
At one point during Morgan's legal battle against Wal-Mart, the corporation's legal counsel attempted to blame Morgan and the passengers for their injuries, stating that the injuries were caused "in whole or in part" by their "failure to properly wear an appropriate available seat-belt restraint device.”
But now that a settlement has been reached, the company has extended an apology.
"Our thoughts continue to go out to everyone that was involved in the accident," said Greg Foran, Wal-Mart's U.S. president and CEO. "While we know there is nothing that can change what happened, Wal-Mart has been committed to doing what's right to help ensure the well-being of all of those who were impacted by the accident. We worked closely with Mr. Morelli [attorney for Tracy Morgan], and we are pleased to have reached an amicable settlement that ends this litigation. We are deeply sorry that one of our trucks was involved."
The terms of the settlement were not disclosed.
