The case of two Black men acquitted of the sexual assault of a white Texas woman just took an interesting turn: in November 2023, Amanda Zawieruszynski accused John Marks and Freddie Douglas Jr. of sexually assaulting her in the pool at Marks’ home in Manvel, Texas.
After the case was thrown out by a grand jury, Marks filed a lawsuit against Zawieruszynski, the City of Manvel, the Manvel Police Department, Police Chief Keith Traylor, and the two officers involved in the case.
She still insists that her claims of rape are true and filed a lawsuit of her own demanding more than $1 million in damages. In the suit, which was filed on Aug. 26 and obtained by Daily Mail earlier this week, she stated that she was held captive and raped violently several times.
The lawsuit also says that “after forcibly removing her clothes, [the men] refused to allow [Zawieruszynski] to leave the pool and forced liquor down her throat, to the point she could not even hold her head up. They refused to allow her to put her clothes on.”
Zawieruszynski alleged she was left “disfigured” and that both internal and external injuries required “surgical intervention.” She also blames the grand jury for dismissing the case.
In her initial police report, Zawieruszynski claimed that she was at Marks’ house because he was hosting a party. She said that she was held against her will by both men and raped at night for hours headed into the morning.
A month later, Marks and Douglas were arrested and charged with aggravated kidnapping and aggravated sexual assault. However, after the evidence was presented to a jury by the local district attorney, they declined to indict both of them in March 2024.
IIn her suit, Zawieruszynski said “she has further required extensive physical and mental treatment as a result of [the] defendants’ actions.” On September 17, Douglas’ lawyer, Michael Kerenksy submitted a brief answer to the lawsuit in which he and his client denied all the allegations.
