Robert “R.” Kelly wants out of jail. Naturally.

Kelly’s attorney, Steven Greenberg has a couple of reasons why his client should be released, one of which happens to be Kelly’s inability to visit all of his girlfriends at once.

“His visits are severely restricted; presently, he is only allowed one unrelated person to visit. In other words, although he lives and has lived with two lady friends, only one of them is allowed to be on his visiting list, and after 90 days he is required to switch,” Greenberg stated in an 11-page motion filed in U.S. District Court in New York Monday, according to CNN. “No other friends or professional colleagues are allowed to visit. That is not right.”

Further, Greenberg has cited Kelly’s health problems as another reason to grant his client some mercy.

According to the Chicago Sun-Times, Kelly has suffered “numbness in his hand, anxiety, and an untreated hernia.” Greenberg also noted the “stifling” conditions Kelly is experiencing in confinement.

The Sun-Times reports:

Though Kelly has been moved to general population in Chicago’s downtown Metropolitan Correctional Center, defense attorney Steve Greenberg argued in the new filing that Kelly’s conditions of confinement “remain stifling.”

Greenberg pointed out Kelly “has a number of health issues which need to be addressed and for which he is not presently receiving adequate medical care.”

Greenberg has continuously tried to convince courts that Kelly is not a flight risk and does not pose a threat to his alleged victims, but has been unsuccessful in his efforts.

In addition to New York, Kelly is facing federal charges (including child pornography, enticing a minor into illegal sexual activity and a conspiracy to obstruct justice) in Chicago, where his trial starts in April. A New York status hearing for Kelly (where Brooklyn U.S. District Judge Ann Donnelly will hear Greenberg’s motion) is scheduled for Wednesday.
