U.S. District Judge Ronald B. Leighton has ordered the reinstatement of an Air Force nurse discharged from the military under the "Don't ask, don't tell" policy that forbids openly gay service members. Leighton told a packed Tacoma, Wash., courtroom that evidence at a six-day trial showed that former Air Force Reserve Maj. Margaret Witt was an "exemplary officer" who should be "reinstated at the earliest possible moment." Witt was discharged after her superiors were notified that she had engaged in an affair with a married woman. The woman’s husband was the informant. Some are suggesting that this is a loss for the Obama administration because the woman was reinstated despite the "Don't ask, don't tell" policy, which might suggest that there is no need for its removal. We think it shows that President Obama's position is legally accurate and that there is no need for the policy, if indeed courts are going to recognize the civil rights of everyone.
