Sixteen years ago, a woman claimed she denied Jamie Foxx oral sex at his Las Vegas home, and then he allegedly slapped her face with his penis and kicked her out. The unnamed woman said she suffered from a panic attack the next day. The allegations surfaced early June, and the actor vehemently denied it ever happened.

As of Friday, the Las Vegas Police Department says the case is closed, according to TMZ, because the statue of limitations expired. The woman also can’t sue in civil court because those have expired as well. Both statute of limitations were three years.

When the news broke, Foxx’s rep said they would go after the woman for filing a false report.

“Jamie emphatically denies that this incident ever occurred, and he will be filing a report with the Las Vegas Police Department against the woman for filing a false police report against him. The first time [Jamie] became aware of this woman’s absurd claims about an incident that supposedly occurred 16 years ago was when TMZ contacted his representatives [Tuesday] about this story,” Foxx’s attorney Allison Hart of Lavely & Singer said.
