You read that headline correctly. According to the Associated Press, a white man named Christian Englander, who threw a banana peel at Dave Chappelle during a 2015 performance in Santa Fe, N.M., is suing the comedian and another man believed to be his bodyguard.
Englander’s lawsuit, filed Friday, claims that the assumed bodyguard struck him twice while he was being restrained. You know, because he threw garbage at Chappelle onstage.
Englander claims that he had no racial motivation when he pelted Chappelle with a banana peel, but says that something the comedian said onstage angered him—hence the fruit tossing. AP reports that Englander was charged with battery and disturbing the peace at the time, but those charges were eventually dropped because Chappelle was “unwilling to participate in the prosecution.”
Apparently, Englander’s claim that he was assaulted while restrained was not included in the initial police report, but his lawyer assured AP that it would’ve become known if the case had gone to trial.
Chappelle has yet to comment on the case publicly, but one thing’s for certain: This ain’t no joke.
