One of Bill Cosby’s accusers may have to pay back hush money she received after settling a lawsuit with the defamed comedian. According to the New York Daily News, Cosby filed paperwork in a Philadelphia court asking for sanctions to be brought against Andrea Constand, who previously signed a confidentiality agreement after receiving a settlement from Cosby.
Constand is one of over 20 women who have accused Cosby of drugging and raping them. Cosby charges that Constand took part in having Cosby’s full deposition released and says she is attempting to bypass the confidentiality agreement they had in a 2006 settlement.
At the time of the alleged assault, Constand was the director of operations for the Temple University women’s basketball team and was invited to Cosby’s home to talk about other career possibilities. Constand stated that Cosby offered her three blue pills after she complained about being stressed. Shortly after taking the pills, she felt sick, becoming dizzy and weak. Constand’s lawsuit alleged that Cosby “touched her breasts and vaginal area, rubbed his penis against her hand and digitally penetrated” her.
Cosby now claims that Constand did not keep up her end of their bargain.
“[Constand] and her counsel, with settlement in hand, are intent on reneging on what they promised defendant—confidentiality and finality—and depriving defendant of his end of the bargain,” Cosby claims in the paperwork filed.
In the paperwork, Cosby goes on to say that Constand now wants to have her cake and eat it, too. The filing doesn’t indicate that he’ll seek repayment of the settlement, but it does state, if she does decide to go public, that she may have to “disgorge some or all of the money paid to her by defendant as part of the settlement.”
Cosby claims that Constand helped leak the New York Times-reported deposition that described his drugging and sex activities with women.
“That conscious neglect has led directly to a colossal breach of that confidentiality,” Cosby’s filing states. “This appalling development violated prior orders of this court, both in spirit and in letter.”
One has to wonder why Cosby doesn’t just quit while he’s ahead. But I guess it’s an attempt to salvage whatever legacy he has delusions about thinking he has left.
